Definition and points to distinguish

Before preparing an employment contract or payroll, it is necessary to check whether an agreement applies and which provisions concern the position. A pay scale, bonus or leave provided for collectively must not be omitted solely because it is not included in an old contract template.

A collective labour agreement sets working conditions within its scope of application. The existence of an agreement in a sector is not sufficient to automatically determine that it applies to every company close to that sector. Its scope, validity and the roles concerned must be checked. Remuneration, classification, working time or benefits may supplement legal rules and must be incorporated into payroll and employment contracts.
