Its definition for direct taxes or VAT should not be assumed to be identical. A physical presence, an agent or a cross-border activity requires an analysis of the facts and applicable texts.

What this changes in practice

A permanent establishment may create a tax connection in a country where a business carries on an activity, under applicable domestic rules and treaties. It is not automatically the same as a subsidiary, a registered branch or the mere presence of a customer. Premises, individuals and their authority to bind the business are important facts. The assessment should be carried out before the cross-border organisation becomes permanent.
